Rent arrears means rent remains unpaid after its due date. The most useful first step is to compare your agreement, rent ledger, receipts and bank records, then identify whether you have received a Form 11, a Form 12 or no formal notice.

What rent arrears means

The RTA says that if a tenant does not pay all rent on the day it is due, the tenant is one day in arrears the following day. Being in arrears does not mean a managing party can immediately remove a tenant. Queensland law uses a notice process with minimum timeframes.

Do not stop paying rent because of a repair, maintenance or other dispute. The RTA states that tenants should continue paying rent while using the separate repair or dispute process.

General-tenancy notice timeline

Standard RTA process for unpaid rent in a general tenancy
StageEarliest or minimum timeframeWhat it means
Rent becomes overdueThe day after the full payment was dueThe rent ledger begins showing arrears.
Form 11 may be issuedWhen the tenant is more than 7 days behindThe Notice to remedy breach gives at least 7 days to pay the outstanding rent.
Form 12 may followAfter an unremedied Form 11 expiresThe Notice to leave gives at least 7 days to move out for an unremedied rent breach.
QCAT applicationIf the tenant does not leaveThe managing party may make an urgent QCAT application within 14 days after the handover day.

These timeframes are for general tenancies. Caravan parks and rooming accommodation have different rules. Read the notice and use the RTA guidance for your accommodation type.

Check the amount before responding

Reconcile the rent ledger
  • Check the weekly or fortnightly rent and the payment due date in the agreement.
  • Ask for an up-to-date rent ledger if you do not have one.
  • Match every payment against bank records and rent receipts.
  • Check the period each payment was allocated to, not only its transaction date.
  • Separate rent from water, utility, repair or other disputed charges.
  • Write down the amount you agree is owing and any amount you dispute.

If a payment is missing from the ledger, send the receipt or bank record promptly and keep proof of the message. If the amount includes something other than rent, ask the managing party to explain the calculation in writing.

Ask early about a workable payment plan

The RTA encourages parties to discuss a breach and try to resolve it, including a repayment schedule for rent arrears. A plan needs to cover both the arrears and the rent that continues falling due.

Simple planning checkongoing rent + affordable arrears payment = total payment each rent periodOnly offer an amount you can realistically maintain. Confirm the total arrears, payment dates and what happens if circumstances change.

Record the agreement in writing. A proposed plan does not automatically suspend or cancel a notice, so ask the managing party to state clearly how the formal process will be handled while payments are made.

If you receive a Form 11

  1. Record when and how it arrived. Service can affect when the notice takes effect.
  2. Check the parties, property, breach and remedy date. Compare the arrears amount with the ledger.
  3. Pay the verified amount within the remedy period if possible. Include rent that becomes due during the process.
  4. Send proof. Ask for written confirmation that the breach has been remedied.
  5. Act on a dispute promptly. The RTA provides free dispute resolution if the parties cannot agree about the breach or whether the notice should have been issued.

If the problem is fixed by the expiry of the breach notice, the RTA says no further action is required for that notice.

If a Form 12 arrives

A Form 12 for an unremedied rent breach is a Notice to leave. Paying after the Form 12 has been issued does not automatically withdraw it. The RTA says the tenant can ask the managing party if the tenancy can continue. Put that request and any agreement in writing.

A property manager or owner cannot personally force a general-tenancy occupant out. If the tenant does not leave, the managing party must seek a QCAT termination order and warrant of possession. A police officer executes a granted warrant.

Urgent record pack
  • Tenancy agreement and current rent ledger.
  • Form 11, Form 12 and proof of when each arrived.
  • Receipts and bank records.
  • Emails or messages about payment arrangements.
  • A short dated chronology.
  • Any RTA dispute number or tenancy advice received.

Disputes and support

Use RTA dispute resolution when there is disagreement about the arrears, the breach notice or a proposed resolution. QCAT may become involved if the matter is not resolved. Tenants Queensland provides specialist tenancy advice, and community legal services may help with legal questions.

If loss of income or hardship is driving the arrears, seek financial counselling early. A financial counsellor can help with a realistic budget and creditor discussions, but cannot change tenancy notice deadlines.

Frequently asked questions

When is rent in arrears in Queensland?

If the full rent is not paid on its due date, the tenant is one day in arrears the following day. For a general tenancy, a Form 11 for unpaid rent can be issued only after the tenant is more than seven days behind.

How long do I have to remedy a Form 11 for rent?

For a general tenancy, the notice gives at least seven days to pay the outstanding amount. Check the notice, service method and accommodation type.

What if I pay after receiving Form 12?

Payment does not automatically cancel the Notice to leave. Ask the managing party in writing whether the tenancy can continue and obtain any agreement in writing.

Can I negotiate a payment plan?

Yes. The RTA encourages discussion and gives a repayment schedule as an example of self-resolution. A plan should cover both arrears and ongoing rent and should be recorded in writing.
